00-cv-0273: TRIPOLI ROCKETRY, et al v. BUREAU OF ALCOHOL Judge Walton 03/23/2009 01:30PM Courtroom 16 Motion Hearing

-- Roger

I was beginning to think for a moment that someone got a date with Judge Judy.

It'll be interesting to see what comes out of the meeting on March 23rd. To be honest though it takes a lot of effort to overcome something that's already being enforced. Still I'd like to be optimistic.

Could this be the hearing they requested three or four months back to see if the judge has any questions/needs more information?

Knowing rocketeers luck, it will be a hearing where the judge will determine that another hearing is needed...and we wait another 3 or 4 years.

It seems to me that we have been put in a permanent holding pattern. All the judge has to go is cancel this one at the last minute like he did the last and we are put off for another year and we have no recourse.

Joint TRA/NAR Statement - Activity in Case 1:00-cv-00273-RBW TRIPOLI ROCKETRY, e

On February 17, 2009 the U.S. District Court for the District of Columbia granted the motion that we filed on October 1, 2008 for a hearing on our long-standing lawsuit against BATFE. We requested this hearing to provide an opportunity for Judge Walton to clarify with all parties whatever facts may have been impeding his delivering a decision on this case. The hearing has been scheduled for 1:30 PM on Monday, March 23 in the E. Barrett Prettyman Federal Courthouse in Washington, DC. We will probably not know more until after this hearing, but will keep our members informed as soon as it is held.

All thats probably going to happen is hes gonna walk into the court room say he has all he needs and will smack the gavel call it a day and leave us hanging for another few years.

Is it possible the judge will have a final ruling at this 'hearing'?

Anything is possible, but I doubt it. On the other hand as I recall the Judge is listed as having the oldest unresolved case (ours!) in the Washington circuit courts. Which would give him an incentive to get it closed as soon as possible.
