Help! Insurance claim suggestions

I just got rear ended while stopped on the way home today. I had been watching her in the mirror as we had progressed start-stop along, as had just said less than a minute before that it was going to be a miracle if we made the interchange without her hitting me...no miracle today.


I've already thrown the work onto my insurance company. Being temporarily out the deductible is cheap to not have to deal with the rest of the hassle.
 
I'm with @CI(VII).

Note it's not just the deductible at stake; my insurance has a "claim free" bonus that builds up $50 each year but gets wiped out even with this type of not at fault claim.
 
I've worked in insurance my entire career, let your insurance company represent your best interest here. It will be a "no-fault" claim on your insurance, so no worries there. This will also be an opportunity for your carrier to demonstrate if they can provide a good customer experience on the claims end.

My biggest fear filing with my insurance (Progressive) is having my rates take a hit even though I was stopped and effectively "rear ended" so I feel I was in no way at fault. Who knows if the lawyers will see it as a "no-fault" on my part. However maybe I'm worying about nothing because Gieco, the at fault drivers insurance, called me yesterday and the other driver admitted 100% fault and that Gieco would accept responsibility. Fairly sure I will still file with my insurance and let them represent me and do the leg work. Thank you for providing an insurance experts opinion.

This should not impact your rates at all. Have your agent confirm this though.
 
I wish my commute allowed for more than a year or two between getting rear ended while stopped, but I think this is at least the 6th time in the last 11 years I have been hit while stopped (may have forgotten one at this point). Between cell phones and people not maintaining their brakes and tires properly I get a new bumper rather regularly. This most recent one was almost certainly 100% cell phone stupid. This is one of the reasons I got rid of my Prius, just too small to keep getting hit like this. A Rav4 isn't big, but the Honda Civic that hit me yesterday clearly lost the encounter.

As a side note, if a Fruity Chute can stop your car more effectively than your brakes it is probably time for some car maintenance. There was one time I saw the guy coming, could see when he hit the brakes, and could almost immediately tell he wasn't gonna get stopped.

if you are legally stop at light or stop sign ...it is their fault. Standard assignment of fault. Don't worry about lawyer saying otherwise. Now one time I rear ended a guy stick on NYS thruway, right after toll booth (1983). Took my end off the road. I argue why is this guy park in the middle of highway. State trooper say yes you are right...gave him a ticket. I did not file a claim since I knew I was at fault and I did not have collision.
